What is your warranty like?

What is your warranty like?

Our standard warranty is as per the New Zealand Building Act 2004. This warranty is implied and covers aspects like proper workmanship, timely completion, suitability of materials, and adherence to the Building Code. The implied warranties apply for up to 10 years from the date of completion.

Our standard warranty covers;

  • Proper and competent work: The work must be done in a skilled and professional manner.
  • Reasonable care and skill: The work must be carried out with due diligence and appropriate expertise.
  • Adherence to contract: The work must comply with the terms of the building contract, including plans and specifications.
  • Compliance with Building Act and Building Code: The work must meet all relevant legal requirements, including the Building Code.
  • Timely completion: The work must be completed by the date specified in the contract, or within a reasonable timeframe if no date is given.
  • Suitability for occupation: The completed household unit must be fit for habitation.
  • Fit for purpose: If the contract specifies a particular outcome and the homeowner relies on the contractor’s expertise, the work and materials must be suitable for that purpose.
  • Use of new materials: Unless otherwise agreed, all materials used must be new.
  1. Effective duration:
  • The implied warranties apply for a period of up to 10 years from the date of completion of the building work.
  • There is also a 12-month defect period within which the homeowner can require the builder to remedy any defects.
  1. Remedies for Breach of Implied Warranties:
  • If the contractor breaches an implied warranty, the homeowner can seek remedies such as requiring the contractor to fix the issue, compensation for damages, or potentially cancelling the contract in serious cases.
  • If a dispute arises, the contractor bears the burden of proving that the defects are not their fault.
  1. Activation of Implied Warranties:
  • To activate the implied warranties, the homeowner should first contact the building contractor to address the issue.
  • If the contractor refuses to rectify the problem or if there’s a disagreement, legal advice should be sought.
  • If necessary, the homeowner may need to take legal action to enforce their rights.

Halo Guarantee

RB Thomas Limited is able to offer the Halo Guarantee, which is only available to members of New Zealand Certified Builders. The Halo 10 Year Residential Guarantee provides cover to property owners for:

Sub contractors and suppliers

Where the NZCB member is the head contractor, defects arising from Materials and Work Supplied by subcontractors and suppliers are covered.

Other damage

The cost to repair other damage to the house caused by the Defect, as per the Guarantee terms and conditions.

Alternative accommodation expenses

Up to 26 weeks alternative accommodation expenses while the house is being repaired.

Professional fees

Surveyors, engineers, legal and other fees necessarily incurred to rectify the agreed defect.

Guarantee transfer

The Guarantee can be transferred to subsequent owners, giving them protection also

Simple application

Simply sign the application your NZCB member has completed. No other documentation is needed.

Make sure all Halo Applications are submitted prior to the Building Works commencing.

How much does it cost?

Generally, the cost of a Guarantee is less than 1% of the total build or renovation cost.
